A Federal Court is an indispensable accompaniment of any Federal Government as an independent and impartial tribunal essential to interpret common rights and federal laws and compel obedience to them. It is an essential element in a Federal Constitution. It is the interpreter and guardian of the constitution as well as a tribunal for the determination of disputes between the constituent units of the Federation. The idea of the establishment of the Federal Court in India as embodied in the White Paper scheme received the unanimous support of the Joint Committee on the Indian constitutional reforms and a provision was accordingly made in the Constitution Act of 1935, for the establishment of the Federal Court in India. The Constitution Act of 1935, except Part II thereof, came into force on 1st April 1937 on which date the Federal Court was also established in India.
